Welcome to the “Bastida” website. Below you will find the terms and conditions (hereinafter “Conditions”) for the purchase and return of our products (hereinafter, the “Products”). By using the website and purchasing our products you accept these Terms and Conditions, so please read them carefully and, if you do not agree with the Terms and Conditions and Privacy Policy, do not use the website. Bastida reserves the right to revise and update the Conditions periodically, such changes will be published in this section of the website.

The sale of articles through this website is carried out under the name Bastida por Bastida SCP, with address in Terrassa, Calle Sant Leopold, 63 and NIF J01918127.

  1. YOUR DATA

The information and personal data that you provide us with will be processed in accordance with our Data Protection Policies, as well as our Legal Notice. By using this website and giving your express consent, you authorise us to process this information and data and declare that all the information you provide us with is true and consistent with reality.

  1. USE OF OUR WEB

The use and/or acquisition of Bastida’s products, whose characteristics are described in the web page (from now on, “Products”), suppose the acceptance as a client (from now on, “Client or User”) of the Conditions contained in the present, as well as the Particular Conditions that could govern the acquisition. 

By using our platform, the User declares that he/she is over 18 years of age and has the legal capacity to enter into contracts.

  1. PROCESS OF PURCHASE
  • PLACING THE ORDER

Orders shall be placed in the following steps:

  1. Selection of the products: The user will select the Products, as well as the desired colour, size and model, and will add them to the cart, where he/she will be able to view the quantity and Products of the order. 
  2. Process order: Once the contents of the order have been reviewed, the user must click on the “process order” The total price of the order (taxes included) will also be displayed, which will include both the price of the products and the shipping costs. 
  3. Registration of delivery and invoicing details: The customer must verify that the data are correct and truthful.

Registration of bank details for payment: The customer will be directed to the secure payment screen managed by the Paycomet platform. Payments can only be made online by credit or debit card, Visa/Mastercard, Credit or Debit card, Bizum and UPI cards.

Once the payment has been made, the user will receive an email with the order confirmation together with the order details (“Purchase Ticket”).

Bastida reserves the right not to validate any order in the following cases: 

– abnormal or abusive claims,

– abnormal orders in relation to the quantities ordered

– abnormal or abusive exchanges and returns

– existing litigation with the customer

  • PAYMENT

Payment is made online by card (credit, debit, Visa/Mastercard, UPI cards) or by Bizum. After the validation of the order on the web, the authorisation of the card payment will be requested, except in cases where the servers are not available. Bastida may request a new payment authorisation in the event that the first one could not be carried out due to the servers being unavailable. 

We have a secure means of online payment that allows encryption of bank details. The data is transferred in accordance with the highest security standards, guaranteed by the Paycomet platform.

  1. SHIPMENTS AND RETURNS
  • SHIPMENTS

Stock permitting, all orders are normally dispatched within 2 working days. Please note that shipping times may increase during periods of high demand. Delivery times are 3-5 working days from dispatch of the order.

  • RETURNS

Bastida, accepts the return and/or exchange of its products within a maximum period of 30 days from receipt of your order, provided that the product has not been used and retains the original packaging and labelling.

For any exchange, return or other after-sales service, it will be necessary to present the receipt of payment by credit card or order confirmation.

*Before returning the order, you must send an email to shop@bastidaforwork.com, to provide you with the necessary information for the return, including the data in this list: Name and Surname, address and number of the order to be returned.

To initiate the return process of orders purchased on the web you must send the Product to the address provided to you via email (with a shipping method that has proof of delivery).

Once Bastida receives your shipment and verifies the date of purchase and the state of the product we will proceed to refund your money as long as:

  1. The product has not been used.
  2. The article is in perfect conditions of cleanliness and conservation.
  3. It is returned in its original packaging and has not been modified in any way.

5.3. RIGHT OF CANCELLATION

The Customer may withdraw from his order without any reason within 30 calendar days of delivery of the Products purchased. In the event of having purchased more than one Product, the period shall be counted from the day on which the last of the Products contained in the order was delivered. This right shall not apply in the event that the Product has been manufactured in accordance with the specifications supplied by you and is therefore a customised Product.

The Client must inform of the decision to cancel the order by sending the request to the following e-mail address: shop@bastidaforwork.com

Bastida will confirm in writing the receipt of the request and the details of how to proceed with the return. For the withdrawal it will be required that the Client has sent his communication before the expiry of 30 days from its delivery, as well as the return of the Products to the address provided by Bastida. 

Bastida will not be the owner of the returned Product until the reception of the same in the return address.

The expenses derived from return postage shall be borne by the Customer. 

Bastida will verify the condition of the returned Products. If the Product has not been unsealed and keeps its original packaging, or if the Product being returned is with the original packaging open, removed from the packaging or without packaging, but it is in perfect condition. If the Products are in perfect condition, Bastida will proceed to refund the amount paid for the Products within 15 days from the return.

If, on the contrary, the Products to be returned have been manipulated in such a way that they have any type of deterioration that diminishes their value, due to the fact that they have been manipulated in a way different from the necessary to check the nature, characteristics and/or state of the same, it will mean that in such cases the exercise of the right of withdrawal will not be admitted.

  • RETURN OF DEFECTIVE PRODUCTS

In the event that the User considers that the Product does not conform to the stipulated in the web, at the moment of delivery, he/she should contact Bastida by sending an e-mail to the following address: shop@bastidaforwork.com

In this email, the user will have to provide the damages suffered by the product, as well as its data. Then, the necessary information for its return will be given.

Once returned, Bastida will proceed to the examination of the returned Product and, within 14 days after its return, will inform the User if the replacement of the Product is appropriate or not. 

  1. DELIVERY AND NON-DELIVERY

The Products shall be deemed to have been delivered when the User or a third party acquires possession of the Products. Such acquisition shall be evidenced by the signature of the receipt of the order at the address provided by the Customer for this purpose. 

In the event that the Products cannot be delivered to the agreed place, the courier company will contact the Customer to inform him/her of the place where he/she can collect the order. 15 days after the Products have been made available (i.e. after they have been made available for delivery) and have not been delivered, the Customer will be deemed to have withdrawn from the contract and the contract will be deemed to have been terminated.

  1. TRANSFER OF RISK AND OWNERSHIP

The Customer shall bear the risks of the Products from the time of delivery. The Client will acquire the property of the Products when Bastida, receives the complete payment of the ordered Products, including the shipping costs, or at the moment of the delivery if this takes place at a later moment. 

The risks of the Products shall be at your expense from the moment of their delivery.
You will acquire ownership of the Products when we receive payment in full for all sums due in respect of the Products, including delivery charges, or at the time of delivery (as defined in clause 8), whichever is the later.

  1. PRICES

*The purchase prices in force at the time the order is placed are those shown on the screen. Taxes and shipping costs are excluded and will be added to the total amount at the end of the purchase process, in the case of taxes, where applicable.

  1. MODIFICATION OF THE CONDITIONS OF SALE

We reserve the right to make changes to our website, our policies and these Conditions of Sale at any time.

You will be bound by the terms and conditions, policies and Conditions of Sale in effect at the time you place your order, unless a change to those terms and conditions, policies or these Conditions of Sale must be made by law or by requirement of public authorities (in which case, such changes may apply to any orders you have previously placed).

If any of these terms and conditions shall be declared invalid, void or for any reason unenforceable, such term or condition shall be deemed severed and such declaration shall not affect the validity and enforceability of any remaining terms and conditions.

  1. LANGUAGE

In the event of any discrepancy between the Spanish version of these Conditions and other versions in other languages existing on the website, the Spanish version shall prevail. 

  1. APPLICABLE LAW AND JURISDICTION 

The use of our website and contracts for the purchase of products through this website shall be governed by Spanish law. 

Any dispute arising out of or in connection with the use of the website or such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts. If you are contracting as a consumer, nothing in this clause shall affect your rights as a consumer under current legislation.
